1. Acceptance of Terms

By downloading, installing, or using FlockEye ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

FlockEye is a location-sharing application for group trips. The App uses real-time location sharing so members can stay within reach of whoever is leading the trip, receive alerts when someone strays too far from that reference, coordinate through group chat, and send SOS signals in emergencies.

3. User Accounts

To use FlockEye, you must:

• Be at least 13 years of age (or have parental consent)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Track or monitor anyone without their explicit consent
• Share location data of others without their permission
• Misuse the SOS feature for non-emergency situations
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use the App to harass, stalk, or harm others

5. Location Services

FlockEye requires access to your device's location services to function. By using the App, you consent to:

• Collection of your location data during active trips
• Sharing your location with other trip participants
• Sharing your location with emergency contacts during SOS events

You can control location tracking by starting or stopping tracking for each trip.

6. SOS Feature

The SOS feature is designed for genuine emergencies. By using this feature, you understand that:

• SOS alerts are sent to all group members
• Misuse of the SOS feature may result in account suspension
• FlockEye is not a replacement for emergency services. The SOS is only sent to the group members and not to emergency services.
• You, or a group member, should call emergency services (911) if you are in an emergency. Response to SOS alerts depends on network connectivity and third-party services

7. Disclaimer of Warranties

FlockEye is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

• The App will be uninterrupted or error-free
• Location data will be 100% accurate
• Alerts will be delivered in real-time under all conditions
• The App will work in areas with poor network coverage

8. Limitation of Liability

To the maximum extent permitted by law, FlockEye and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App.

Important: FlockEye is a coordination and safety utility, but is not a guarantee of safety. Users should always take appropriate precautions for their activities and not rely on the App for emergency response. The SOS is only sent to the group members and not to emergency services.

9. Indemnification

You agree to indemnify and hold harmless FlockEye and its operators from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App at any time, with or without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time through the App settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FlockEye operates, without regard to its conflict of law provisions.
